TERMS AND CONDITIONS

1.  INFORMATION ABOUT US AND HOW TO CONTACT US

 

1.1 We are Motion Cinema Ltd trading as Escape Quest. Our NZBN is 9429030030886. Escape Quest is a New Zealand owned company.

1.2 You can contact us by using the contact details as set out in the Contact Us section of our website.

 

1.3 If we have to contact you we will do so by telephone or email using the contact details provided to us in your booking or enquiry.

2.  PRICING, BOOKINGS AND PAYMENT

 

2.1  All pricing is displayed and charged in New Zealand dollars and includes relevant taxes. Escape Quest reserves the right to alter published prices at any time.

 

2.2  Only person(s) aged at least 18 years are permitted to book a game. Where a customer is booking tickets on behalf of themselves and other members of a group, that person must be authorised to make the booking on the basis of acceptance of these Terms and Conditions by all persons involved in the booking and by a parent or guardian for anyone under 18 years of age when the booking is made.

 

2.3  Minimum age for escape room players is 7 years. Players under 12 years must be accompanied by an adult.

2.4  Customer safety is Escape Quest’s top priority. It’s important if you have a medical condition that you seek professional health advice prior to booking one of our escape rooms or VR experiences. Escape Quest does not take responsibility for customers’ medical conditions whilst playing at Escape Quest. Vertigo sufferers should note that VR escape games include moments of virtual climbing which gives the illusion of being high above the ground.

 

2.5  Bookings and payment can be made online at www.escapequest.co.nz or in person at our premises. Payment for the escape game(s) will be due in full at the time of booking. Price and payment details will be confirmed during the booking process prior to payment and on your booking confirmation. Your chosen payment method will be charged as indicated during the booking and payment process.

 

2.6  It is your responsibility to check that any booking details issued to you are accurate and your details are correct on the online booking form. By submitting an online booking form you warrant to Escape Quest that all details supplied by you are true and accurate.

 

2.7  Our acceptance of your booking will take place when your payment is processed successfully and you reach the booking confirmation page or are provided with a receipt on premise. At this point a contract will come into existence between you and us. We will also send you an email confirmation. Escape Quest will not send further confirmation via post or text message. Your booking confirmation is also your ticket to your mission and valid for up to the number of people shown on the booking confirmation.

 

2.8  We accept the following methods of payment on our website, through our secure booking service supplier PayPal, who will process your payment card data without it having to be held by us:

(1) Visa Debit and Credit Card
(2) MasterCard Debit and Credit Card
(3) American Express Charge and Credit Card. We do not accept American Express for over the counter payments at our premises.

 

2.9  When requested in writing, we also accept invoice payments. In this situation we shall forward you an invoice along with your payment link. Please note that this option is available exclusively to registered businesses booking for team building. The invoiced price must be paid in full before the date of your experience otherwise access to the venue may not be granted or your booking might be cancelled.

3.  CANCELLATION, RESCHEDULING, BOOKING CHANGES AND NO-SHOWS

 

3.1  Escape Quest hosts live experiences and once a booking is confirmed, we cannot accept cancellations or offer refunds.

 

3.2  Re-scheduling your booking may be possible, but only at the discretion of Escape Quest. Rescheduling is free of charge provided you inform us at least 3 days in advance of your original booking date and is subject to availability. If less than 3 days notice is provided, we reserve the right to charge a $20 rescheduling fee. If, for whatever reason, we are unable to accommodate your booking on an alternative date, you will not be due a refund.

 

3.3  If 3 or more days notice is provided at cancellation, issuing a voucher for the equivalent booking value to be used at a later date may be possible, but only at the discretion of Escape Quest.

 

3.4  As Escape Quest is a live event with a scheduled start time, you are responsible for ensuring that all of your group of players arrive at the time stated on your booking confirmation, which is generally 10 minutes before your game start time. Games will not be delayed for late arrivals, although we will allow late arrivals into the room after your escape game has begun, but not more than 15 minutes into the game. Please note that the 15 minutes cut-off time only applies to our escape rooms. For VR experience bookings you will be required to be all present for the start of the game.

 

3.5  If your party has not arrived 15 minutes after your booked game start time, this will be treated as no-show and we may refuse entry to your game. No refund or rescheduling is available for no-shows.

 

3.6  It is your responsibility to make your way to our business premises to play your game at the time stated on your booking confirmation. We do not provide parking or other travel arrangements and any travel information provided on our site is only done so as an aid to planning your visit. We cannot be held responsible for any failure of transport arrangements that result in your booking being a no-show.

 

3.7  To the extent that you bring less players to Escape Quest than booked, the price difference will not be refunded. Please note that there is a minimum of two players required for any game.

 

3.8  If more people attend the game than are booked (up to 6 persons per room) the extra can be paid prior to arrival (call us to add additional people on +64 3 442 4948) or upon arrival at the game.

4.  GAME PLAY AND CONDUCT

 

4.1 No video recordings or photos are allowed inside the rooms. You are expected not to use any video/audio recording device during the game (this includes,without limitation, mobile phones, recording devices and cameras).

 

4.2  If you are a blogger, vlogger, press representative planning to film or take photos at our venue for review purposes, then please get in touch at queenstown@escapequest.co.nz for permission.

 

4.3  We expect you and your group not to disclose any details of the game directly or indirectly to any third party members. Our games are our intellectual property and you are not permitted to use this in any way without our written consent. You accept that any such disclosure or use may constitute an infringement of our intellectual property rights. Ubisoft terms & conditions apply separately to the VR experiences.

 

4.4  We are entitled to charge our customers for any damage which is intentional and/or caused by misuse of company property within the briefing area(s) and the escape room(s).

 

4.5  While you are on our premises, you must ensure to conform to our codes and regulations, adopt proper standards of behaviour, and cooperate with our employees. People under the influence of alcohol or drugs may be turned away or removed from our premises by our employees and their booking cancelled or ceased early with no refund.

 

4.6  We do not tolerate any kind of bullying or harassment towards our employees and we reserve the right to remove from our premises any person who is violent, abusive, threatening or disruptive or whose behaviour is causing distress to other customers or employees, with no refund for booked or partially played missions.

 

4.7  Swearing or abusive words are strictly forbidden during VR experiences shared with other teams.

 

4.8  Food and drinks are not allowed inside the escape rooms and alcohol consumption is strictly forbidden within our premises, unless you have obtained the management’s written consent prior to your booking.

 

4.9  You will receive instructions before the mission in the form of a briefing given by a game host. After learning the rules and objectives of the mission and receiving the information provided at the briefing, you and your group will participate in the event at your own risk. We are not liable for any damage caused to persons, possessions or materials by your failure to follow the instructions given before the event.

 

4.10  CCTV will be used to monitor you and your team during the course of your mission. This includes audio and video monitoring as it is an essential part of running your game. Recordings of your game may be stored for up to 48h with the sole purpose of documenting evidence of illegal behaviour, such as committing wilful damage to company property or harassing members of staff.

 

4.11  Photographs of you and your team will be taken after the mission and uploaded to Facebook (without identification tags) for you to access. By accepting these Terms and Conditions and permitting our employees to take photographs, you grant unconditional permission for those photographs to be used by us for marketing and promotional purposes. If you do not want your team photograph to be used in this way, please advise our employee at the time your photo is taken.

5.  PERSONAL INFORMATION

 

5.1  We will only use the personal information you provide to us as set out in our Privacy Policy.

6.  OUR RESPONSIBILITY FOR LOSS OR DAMAGE SUFFERED BY YOU 

 

6.1  Escape Quest shall not be liable to any person for any direct or indirect, consequential or incidental damages, including (without limitation) lost profits or revenues, loss of opportunity, costs of replacement goods or services, loss or damage to data or business interruption, arising out of any use of the website. We accept no liability for consequential losses incurred as the result of the cancellation or premature cessation of a booking under any circumstances.

 

6.2  Whilst your escape experience is insured, you undertake to act carefully whilst within the experience and will not take unnecessary risks such as climbing on unsafe surfaces that are not designed for that purpose. The game does not require such activities and customers are made aware of that by staff during the briefing. You are responsible for your own safety during the experience. Escape Quest is not liable for any (personal or equipment) damages caused by game play, game room misuse or not following the rules described before the game.

 

6.3  The absolute limit of direct liability to you, howsoever arising under or in connection with the contract, shall be limited to 100% of the price paid for that booking or payable by you under the contract.

 

6.4  These terms are governed by the law of New Zealand
